Step onto the court and prove your program’s dominance at the We Up Elite BATTLE OF THE PROGRAMS!
This is more than just a tournament—it’s a showdown to determine which program is the best of the best. Teams will compete not only for division and bracket wins, but for the prestigious title of top program. Only the strongest will walk away with We Up Elite championship medals, and the top three programs will be awarded 1st, 2nd, and 3rd place trophies.
Teams will compete in Elite and Intermediate levels. The Elite level will accumulate more points and allow for more teams in bracket play, creating an extra competitive edge. Intermediate teams will compete in their own pool play, with the top two teams advancing to bracket play, where they’ll face off in the first round. This ensures a level playing field, while still giving the Intermediate teams a shot at bracket glory.
The tournament is open to both boys and girls teams, grades 5-12th, making for an exciting and highly competitive event. Please note, all schedule requests must be submitted in writing at least one week before the event. While we can’t guarantee every request will be honored, we’ll do our best to accommodate your needs.
We Up Elite – Spectator General Waiver and Release of Liability, Assumption of Risk, Concussion Policy, and Indemnity Agreement
I affirm that I am at least eight (8) years of age or have reached the legal age of majority in my jurisdiction. I understand that while attending the We Up Elite Battle Of The Programs, I am expected to always behave appropriately. This includes complying with all local, state, and federal laws, and showing respect for all individuals, equipment, facilities, and property associated with the Event.
I acknowledge that We Up Elite, has the authority to remove me from the Event at any time, without written notice or refund, if my behavior is deemed to endanger the safety of others or negatively impact the Event, its participants, facilities, or property. I further agree to indemnify and hold harmless We Up Elite, its employees, and representatives from any third-party claims that arise in whole or in part due to my negligent or intentional actions or omissions.
I grant permission for my image to be captured in photographs, motion pictures, or recordings taken during the Event. I understand that these images may be used by We Up Elite for advertising, marketing, or promotional purposes. I assign all rights, title, and interest in any photographs, motion pictures, recordings, or other media I may capture at the Event to We Up Elite. However, We Up Elite grants me a limited, non-exclusive, perpetual right to use such media for non-commercial purposes only.
Assumption of Risk of Personal Injury, Illness, and/or Property Damage
I acknowledge that attending the Event may expose me to COVID-19 or other communicable diseases, which could result in infection, even if I do not show symptoms. Therefore, I agree that I will not attend the Event if, within the fourteen (14) days prior to the Event, I have:
Tested positive or presumed positive for COVID-19 or another communicable disease or been identified as a potential carrier.
Experienced symptoms that are commonly associated with COVID-19 or other communicable illnesses.
Been in direct contact with, or in close proximity to, any person confirmed or suspected to be infected.
I understand and accept all risks associated with exposure to communicable diseases. I acknowledge that my attendance is voluntary and may result in personal injury (including death), illness, or property damage. I agree to comply with all We Up Elite identification policies, including wearing and displaying proper credentials or wristbands for the duration of the Event.
I further agree to follow all We Up Elite policies, remain alert, and be aware of my surroundings. I acknowledge and accept all risks associated with:
Being a spectator before, during, and after basketball games, including warm-ups, practices, pre-game and post-game activities, halftime entertainment, promotions, and competitions.
Attending, observing, or participating in any aspect of the Event.
Concussion Policy
If a player is suspected of exhibiting symptoms of a concussion—such as headache, dizziness, confusion, nausea, loss of balance, blurred vision, sensitivity to light or noise, or loss of consciousness—We Up Elite staff and/or officials reserve the right to immediately remove the player from participation.
Any player removed due to suspected concussion symptoms will not be permitted to return to play on the same day.
A player may only return to play after providing written clearance from a licensed physician.
By participating in this event, I confirm that I understand and will comply fully with this concussion policy. I also release We Up Elite from any liability related to concussion-related restrictions or decisions.
General Release of Liability and Covenant Not to Sue
On behalf of myself and any individuals accompanying me, I hereby waive, release, discharge, and agree to hold harmless We Up Elite, its owners, officers, employees, contractors, volunteers, sponsors, and representatives (collectively referred to as “Released Parties”) from any and all claims, liabilities, or demands that may arise in connection with my attendance, participation, or presence at the Event.
This release includes, but is not limited to, claims related to personal injury, wrongful death, illness (including COVID-19 or other communicable diseases), property damage, invasion of privacy, or any claims associated with photographs, videos, broadcasts, or promotional materials created during the Event.
If I am accompanied by minors, I confirm that I have the legal authority to grant these waivers and releases on their behalf as their parent, legal guardian, or authorized agent. If I do not possess such authority, I understand that the minor(s) must leave the Event immediately.
I further agree to indemnify, defend, and hold harmless the Released Parties from any and all claims, demands, lawsuits, costs (including reasonable attorneys’ fees), and liabilities that arise from:
Any claims that have been released under this agreement.
My actions or omissions, or those of any individuals accompanying me.
Any breach of the terms outlined in this agreement.
Acknowledgement
I confirm that I have read this Spectator General Waiver and Release in its entirety and that I fully understand its contents. I acknowledge that this agreement is legally binding upon me, my spouse, my children, my legal representatives, and my heirs, successors, and assigns.
